Terms of Use

Last updated:

These terms (the "Terms") are a binding agreement between you and Narek Keshishyan, an independent developer who operates Hearth ("we", "us"). They cover the Hearth iOS app (the "App") and the website at sayhearth.com (together, the "Service"). By installing, opening or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

Read this first

Hearth is a bookkeeping tool. It is not a bank, a payment service, or a financial, tax, legal or investment adviser, and nothing it shows is advice. It never moves money. Hearth uses an AI model to read what you say and type, and it can mishear or misread: check the entries it saves, and correct or undo any that are wrong. The budget guidelines Hearth shows, like "savings at 20%", are general rules of thumb, not recommendations for your family.

Eligibility

You must be at least 18, or the age of majority where you live if that is higher, and able to enter a binding contract, to create or join a household. Hearth is not directed to children; a child may appear in a household only as a name an adult adds.

Your household

The adult who creates a household is its owner. Adults who join by invite can see and change the whole plan and every entry. You decide whom to invite, and you are responsible for the people you let into your household and for what you record about them; you confirm that you have the right to add the names of the family members you record. The owner can delete the household for everyone. If you delete your account, the household stays with any other adults in it.

License to use the App

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on Apple devices you own or control, for your personal and household use. All rights not expressly granted are reserved.

Acceptable use

You agree not to:

The Family plan

Setting up your household is free. After that, Hearth needs an active Family plan or its free trial. If the plan lapses, your household can still see, edit, type entries and export everything; voice logging and Hearth's AI reading of what you say or type pause until a plan is active again.

AI and automatic reading

Hearth uses a third-party AI model, currently provided by Anthropic, to turn what you say or type into entries and to run the spoken setup. The results are produced probabilistically and can be wrong: an amount, a line, a person or a date may be misread. Hearth saves entries straight away so that logging is quick, which is why every entry can be undone, edited or deleted. You are responsible for checking the entries in your budget. We do not warrant that any entry, estimate or suggestion is accurate or suitable for your household.

Exchange rates and budget figures

Amounts in other currencies are converted at a daily reference rate, which can differ from what your bank charged; you can overwrite any converted amount. The estimates Hearth offers during setup are marked as estimates for you to confirm. Totals, what's left this month, the pot and the savings figures are arithmetic on what your household entered, not statements from any bank.

Your content and data

You own what you and your household put into Hearth. You grant us a worldwide, royalty-free, non-exclusive license to store, transmit and process it only as needed to run the Service for your household, as the Privacy Policy describes. You can export it as CSV from the App whenever you like once your household has started the plan or its trial, even after it lapses, and delete it as described there.

Intellectual property

The Service, including the App, this website, the software, the design, the text and the name "Hearth", belongs to us or our licensors and is protected by intellectual property laws. These Terms do not transfer any ownership to you.

Feedback

If you send us feedback or ideas, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose, without obligation to you. You confirm that what you send is your own and does not violate anyone else's rights.

Service availability and changes

We may change, suspend or discontinue any part of the Service. We will try to give reasonable notice of significant changes, so that you can export your data first. Hearth keeps a working copy of your household on your phone, but some features, such as sync, reading what you say, and invites, need our servers.

DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY ENTRY, FIGURE OR SUGGESTION WILL BE ACCURATE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL HEARTH, ITS MAKER OR ANY OF ITS SUPPLIERS OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, INCLUDING ANY FINANCIAL DECISION YOU MADE BASED ON IT, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) US $50.

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, SUCH AS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FOR FRAUD.

Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend and hold harmless Hearth and its maker, suppliers and service providers from any claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees) arising out of: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any law or of anyone's rights; or (d) anything you or your household record in the Service.

Apple App Store terms

If you got the App through the Apple App Store, the following also applies:

Termination

You can stop using the Service at any time by deleting your account in the App and uninstalling it. If your household never started the Family plan or its trial, or you stopped partway through setup, write to [email protected] and we will delete your data as our Privacy Policy describes. We may suspend or end your access if we reasonably believe you have broken these Terms or that your use puts us, other users or anyone else at risk. The sections that by their nature should survive termination (including the disclaimers, the limitation of liability, indemnification, intellectual property and governing law) survive.

Changes to these Terms

If we change these Terms in a way that matters, we will update the date at the top and tell you in the App or on this website before the change applies. Continuing to use the Service after a change means you accept the new Terms. If you don't agree to a change, stop using the Service.

Governing law and venue

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Subject to any mandatory consumer-protection law that gives you the right to bring a claim where you live, you and we agree that any dispute about these Terms or the Service will be brought only in the state or federal courts in San Francisco County, California, and we both consent to their jurisdiction.

Miscellaneous

Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service. Severability. If a provision is unenforceable, the rest stays in effect and that provision is enforced as far as allowed. No waiver. Not enforcing a provision is not a waiver of it. Assignment. You may not assign these Terms without our written consent; we may assign them in a merger, acquisition or sale of assets. Force majeure. We are not liable for delays or failures caused by events outside our reasonable control.
